1. Vendor Basics
Keeping in mind these basic requirements will set you up for success on LOMA.
a. What can be sold on LOMA
LOMA is a unique marketplace. Buyers come here to purchase advertising to support their business.
If you sell on LOMA, you need to provide the following information for each of your products:
- A short and long description of the company and the offering
- Your logo, photographs or video content — Image requirements are 1440 x 1440
- Your product offering and price point. The price you provide to LOMA is your take-home price, not the end price the customer will pay. LOMA fees and Stripe payment processing fees will be added on top of the price of the product offering.
- Benchmark Key Performance Indicators are required. KPI results from the product are to be uploaded and will display on the results page.
- Required to set up payment processing through Stripe
We encourage you to be transparent about the product offering and provide as much detail that will help sell your product.
LOMA may remove any listings that violate our policies. LOMA may also suspend or terminate your account for any violations.
b. Managing your LOMA profile
By selling on LOMA, you agree that you will:

Provide honest, accurate information to LOMA and in the marketplace

Ensure your content, such as any text, photos or videos used to represent your listings, abide by LOMA policies.

Accurately represent your products, including any details you provide about the offering, returns, case studies and listing photos.

Not facilitate off-platform transactions.

Not coordinate pricing with other vendors.
c. Vendor Standards
By listing a product for sale on LOMA you understand and agree that you are responsible for complying with all applicable laws and regulations for the products you list for sale. LOMA assumes no responsibility for the accuracy, labeling, or content of your listings.
The vendor hereby represents that they have the expertise, knowledge and experience needed to provide the goods or services outlined in the marketplace.
The vendor shall indemnify, defend, and hold LOMA, the buyer, and its representatives harmless for any loss or damage. Furthermore, LOMA and the buyer agree to hold the vendor harmless against any loss or damage, save in cases of gross misconduct or negligence by the vendor or its representatives.
The vendor agrees to purchase the necessary insurance during the term of this agreement and upon request shall provide proof of such insurance to LOMA. In the instance the vendor should fail to maintain or provide proof of insurance, LOMA shall consider such actions to be a breach of this vendor agreement and will be grounds for termination.
If any legal action occurs the prevailing party shall be entitled to a refund of any and all costs including attorney fees, court fees, and travel fees.
Meeting Service Level Standards
As an vendor, you must provide great customer service and maintain trust with your buyers.
By selling on LOMA, you agree to:
- Honor your processing times. Vendors are obligated to complete a transaction with a buyer in a prompt manner, unless there is an exceptional circumstance.
- Respond to Messages in a timely manner.
- Honor the commitments you make
- Resolve disagreements or order issues directly with the buyer.
- If you are unable to complete an order, you must notify the buyer and cancel the order.
- All returns, payment discrepancies, transaction details are handled between vendor and buyer.
d. Vendor Fees
Vendors may be charged for using some of LOMA’s services. There may be fees associated with listing and selling products on LOMA’s marketplace
2. Being on the LOMA marketplace
As an vendor, you have additional responsibilities to safeguard personal information and communicate promptly with buyers in order to provide a great customer experience.
a. Creating and Uploading Content
As a member of LOMA, you have the opportunity to create and upload a variety of content, like listings, messages, text, photos, and videos. In order to keep our community safe and respectful, you agree that you will not upload content that:
- Contains hateful or derogatory language or imagery;
- Contains threats, harassment, extortion, or violates our rules about interference;
- Violates someone else’s intellectual property rights;
- Is false, deceptive, or misleading;
- Contains unsolicited advertising or promotions, requests for donations, or spam;
- Contains private information, whether it is your own, or someone else’s;
- Encourages or facilitates an off-platform transaction;
- Contains prohibited medical drug claims;
- Sexualizes minors under the age of 18;
b. Privacy and Protecting Personal Information
You are responsible for protecting members’ personal information you receive or process, and you must comply with all relevant legal requirements. This includes applicable data protection and privacy laws that govern the ways in which you can use LOMA user information. These laws may require that you post and comply with your own privacy policy, which must be accessible to LOMA users with whom you interact. Your privacy policy must be compatible with this policy and LOMA’s Terms of Use, and LOMA's Privacy Policy.
In particular, when you sell using our Services (subject to this Policy) or use LOMA’s API (also subject to the LOMA API Terms of Use), you may receive and determine what to do with certain personal information, such as when communicating with users and entering into transactions with buyers. This means you process personal information (for example, buyer name, email address) and, to the extent you do so, you are an independent controller of data relating to other users that you may have obtained through the Services. As a data controller (that is someone who decides what personal data is collected and the purpose you’ll use the data for) to the extent that you process user personal information outside of the Services, you may be required under applicable data protection and privacy laws to honor requests received from such users for data access, portability, correction, deletion, and objections to processing. Also, if you disclose personal information without the buyer’s proper consent, you are responsible for that unauthorized disclosure. This includes, for example, disclosures you make or unintentional data breaches. For example, you may receive a buyer’s email address or other information as a result of entering into a transaction with that buyer. This information may only be used for LOMA-related communications or for LOMA-facilitated transactions. You may not use this information for unsolicited commercial messages or unauthorized transactions. Without the buyer’s consent, and subject to other applicable LOMA policies and laws, you may not add any LOMA member to your email or physical mailing list, use that buyer’s identity for marketing, or obtain or retain any payment information. Please bear in mind that you're responsible for knowing the standard of consent required in any given instance. If LOMA and you are found to be joint data controllers of personal information, and if LOMA is sued, fined, or otherwise incurs expenses because of something that you did in your capacity as a joint data controller of buyer personal information, you agree to indemnify, defend and hold LOMA (and its employees, agents, consultants, subsidiaries, partners, affiliates, and licensors) harmless against any claims, costs, losses, damages, liabilities, judgements and expenses (including reasonable attorney fees) in connection with your processing of buyer personal information.

c. Communication Standards
Messages
With LOMA "Messages", you have the ability to communicate directly with your buyers. Messages are a great way for buyers to ask you questions about an item or an order.
Messages may not be used for the following activities:
- Sending unsolicited advertising or promotions, requests for donations, or spam;
- Harassing or abusing another member or violating our Anti-Discrimination Policy;
- Contacting someone after they have explicitly asked you not to; or
- Interfering with a transaction or the business of another member.
- Exchanging personal contact, financial or other information for the purposes of making an off-platform transaction, including phone number, address, email, social media handles, external URLs, instructions for money transfer, QR codes, etc.
Interference
Interference occurs when a member intentionally interferes with another member’s offering in order to drive away their business. Interference is strictly prohibited on LOMA.
Harassment and Discrimination
Any use of Messages to harass other members is strictly prohibited. Similarly, Messages may not be used to support or glorify hatred or otherwise violate our Anti-Discrimination Policy. If you receive a Message that violates this policy, please let us know right away.
3. Onboarding
LOMA may make changes to onboarding or authentication processes for sellers at our sole discretion. Completion of these processes may be required for seller account activation or continued access and usage.
Access to the vendor portal will allow the vendor to set up their product in the marketplace. The vendor maintains the role of adding content to the vendor portal.
If LOMA has reason to believe you, Your Content, or your use of the Services violate our Terms, including this Seller Policy, we may deactivate, or suspend or terminate your account (and any accounts LOMA determines are related to your account) and your access to the Services. Generally, LOMA will notify you that Your Content or account has been suspended or terminated, unless you’ve repeatedly violated our Terms or we have legal or regulatory reasons preventing us from notifying you.
